Firework Information

FIREWORKS ORDINANCE:

The City of Fountain City Council has approved Fireworks with the following rules:

  • Sales and Use of Fireworks only approved from May 31 through July 6 each year, depending on any posted restrictions.
  • Legal fireworks are those sold in El Paso County Fireworks Booths (Class C)-no flying or exploding fireworks or firecrackers
  • You must be 16 years of age or older to purchase, transport or sell Class C fireworks in Fountain


PERMISSIBLE FIREWORKS


Permissible fireworks are non-explosive and are not intended to leave the ground. Specifically, they are small firework devices that produce audible or visual effects through combustion.

The types of fireworks that are permissible in Colorado are:
- Fountains
- Ground Spinners
- Illuminating Torches
- Dipped Sticks and Sparklers
- Toy Propellants
- Trick Noise Makers
- Tube Devices

Permissible fireworks may not contain more than 50 milligrams of explosive composition.

ILLEGAL FIREWORKS

Fireworks that are always illegal to use in Colorado (except for public and professional displays) are:

- Firecrackers
- Rockets (including bottle rockets)
- Roman Candles
- Cherry Bombs
- Mortars and similar items, such as M-80s

EXECUTIVE ORDERS

The Governor of Colorado can issue an Executive Order to ban the use of fireworks when conditions of extreme fire danger exist, pursuant to Section 24-33.5-1225, C.R.S. An executive order is enacted to reduce the danger of forest fires throughout the state of Colorado. The ban is removed when hazardous conditions no longer exist.
Executive orders banning open burning, including the use of fireworks, were issued in 2002 and 2012. These bans did not supersede more comprehensive bans on firework restrictions established by counties or local municipalities.

WHERE IS THE BEST PLACE TO DISCHARGE FIREWORKS?

The office of Fire Prevention Division recommends discharging all legal fireworks in a safe location. Outside of homes or businesses, away from dry combustible vegetation, away from combustible structures (i.e. sheds, wood fences, overhangs). Keep a safe distance as recommended by the firework manufacturers, please read directions and warning labels on each brand and style firework.

NEED TO DISPOSE OF FIREWORKS, OF ANY TYPE?

PLEASE, DO NOT THROW AWAY UNDISCHARGED FIREWORKS. If you are in need to dispose of fireworks, of any type. Please place them in a dry cardboard box, bring them to the Fountain Fire Station No. 1 at 811 N Santa Fe Ave. Turn them into the Fire Prevention Division for proper disposal, no questions asked.
